Section 1.18 – Restrictions on the Laws of the Land

These bulleted items are found in the original Constitution or in its Amendments.  The first bulleted item dealing with freedom of religion comes from Amendment 1 meaning freedom of religion was not in the original Constitution.

That is correct!  Freedom of religion was not in the original Constitution!  The statement regarding religion was added in the Bill Of Rights.  And, the Bill Of Rights only says that Congress cannot establish a religion or prevent the free exercise of religion.  It does not, however, guarantee freedom of religion as it relates to the Executive Branch, or non-governmental organizations, or individuals.  It doesn’t say others cannot force their religious preferences on The People.  Is this an oversight?

In the New Constitution, freedom of religion is fully guaranteed.  First, “Congress will make no Law respecting establishing a religion, requiring or recommending religious practices, or prohibiting the free exercise of religion.”  Second, “No Person or organization of Persons will be allowed to force their spiritual views on others.”  This protects us from the government and ourselves.

The other bulleted items:

  • From Article 1, Section 9, the Writ Of Habeas Corpus could be suspended by Congress in the original Constitution. This has not changed in the New Constitution except it requires a two-thirds majority instead of a simple majority.
  • From Amendment 4, “warrants issued with probable cause” has been reworded.
  • From Article 1, Section 9, “No Bill of Attainder or Ex Post Facto Law will be passed.”
  • From Amendment 5, “No Person will be held to answer for a capital crime…” is reworded.
  • From Article 1, Section 10, comes a reworded “No title of nobility will be granted by the United States.”
